Open Question: Is running a company into the ground to profit from short selling it illegal?

I just recently read several biographies on Jay Gould. He was a businessman who made money in speculation and railroads around the time that John D. Rockefeller was building up Standard Oil. Gould was notorious for taking over a railroad, building it up with his management skills, and then profiting from running the company into the ground by short selling. So, my question is this: in today's world, are there any laws concerning how much a manager, director, or any other corporate executive can be involved in the trading of their own company? If I am a corporate exec with talent, lets say i go and build a company up, drive the stock prices up and then begin short selling. After I do this, I begin "officially" cutting costs and trying to improve profitability; in doing this, I begin cutting back people's salaries and begin firing all the good people, replacing them with handpicked people who I know are incompetent and in over their heads. I then wait a little while for them to start screwing up, and then after the company begins to fall apart and the prices go to the dump, I buy back my shares and return them to my broker, and I make a profit from this. Could I do this? Are there any legal implications in this? If so, could I circumvent it by providing several "associates" money buy up the stock in the company I work for, and then after we pull off the sell, I give them a cut of the profit for their help? This is certainly unethical, but is it illegal? I guess this would be called the Pump, Cut, Collect, and Run scheme. I am not a stock trader myself, and as such I have very limited knowledge of the stock market. Comments appreciated! more

Open Question: Can anyone help with the get Richard Cartridge back on BBC Radio Solent Petition?

We are running a campaign to get Richard Cartridge back on air with BBC Radio Solent. The management of the station are ignoring the listeners wishes to re-engage Richard. As license payers we feel that we should have a say. Richard was the most popular presenter on the station pulling in almost 450,000 listeners on his daily weekday show. The listener figures have now dropped to less than 270,000 and we fear that if the listener figures drop further we will lose our local radio station. Talent such as Richard's should be utilised to the stations best advantage. When Richard was originally "let go" it was because the previous managing editor didn't want to "hear old voices on the radio." This smacks of ageism and it looks like nothing has changed. The Marlins GM said a few days ago after putting Cody Ross on waivers, "Well, you can consider this waving the white surrender flag on the season." I am not sure if those were his exact words but it was very close. The Marlins did have a chance to make a run at the wild card spot a few weeks ago (they weren't that far out of it) but the management gave up. They didn't get any players by the trade deadline. They actually traded away one of their stars- Jorge Cantu. It's like they gave up right after the all-star break. Why would anybody buy a ticket to watch a team that gave up on the season? What kind of marketing tactic is that anyways? And, on top of this, the team has already been strictly warned before the season that they must spend much more money to make their team competitive. They have the money but they are not spending it. So why would someone want to watch a team that doesn't want to be competitive? If a car maker said, "We're not going to spend a lot of money making cars this year. Anyone who buys one of our cars will be getting an inferior product." Would you want to go out and buy one of their cars? And on top of it, they gave their best talent (engineers and designers) away to other carmakers! Even the most loyal fans of that carmaker would not buy one of its cars!And we're in a deep recession in Florida. How can a team think that they can get away with pulling this crap right now. They can't pull this crap during a recession. Why would a guy who is financially hurting go spend his money on a team that doesn't give a crap? more

Tuesday night on WWE's NXT program, Kaval slipped in a not-so-subtle reference to TNA in the middle of his opening-segment rap. I'll try to keep this brief. I am a sophomore college student that works for a company that recruits college students to run their own painting companies for the summer. This past summer, I worked as in an executive management position in which recruited and managed a team of 14 college students, called "branch managers," that run their own businesses and grossed over $600K in sales for the company. After two years with the company, I am leaving and they are not paying me what I deserve. I am threatening several things if I do not get paid my full commission, such as: 1. Convincing none of the branch managers for my team to return to the company for a 2nd year(the company relies solely on internal recruiting for people in my position). This would eliminate a big part of their upcoming talent pool and hurt their growth for next year. 2. Convincing other executive managers in my position to not return (severely limiting growth prospects for the company). 3. E-mailing the entire branch manager employee list telling them not to return to the company. 4. To recruit new branch managers, the company blast e-mails colleges and universities (they obtain these e-mail lists rather unscrupulously). Since I performed this process last year, I have the e-mail lists and could blast e-mail college campuses warning students about the programs and telling them to stay away from it. 5. I could contact the career services offices of targets colleges and tell them not to allow the company to recruit on campus. 6. E-mail the company's private financial information (heavily guarded by the President and VP) to other executives and show them the financial problems the company has, seeding doubt that they will ever get paid. 7. Contact the EPA and let them know of numerous lead-safety violations that the company incurs, allowing the company to face thousands of dollars in fines. 8. Contact the Department of Labor and let them know of several unethical / illegal instances in in regards to manager and painter payment. As the top manager in the company, I am in a position to really hurt the company long-term. I just want to know: is it illegal for me to walk into a meeting with my boss and say that if I do not get x amount of $'s, I will do the things above? Does this qualify as extortion or blackmail? I think he had a right to leave because Cavs never gave him enough talent to win with. In his 7 seasons the two best players he played with at the same time was Mo Williams and a 34-year old Antawn Jamison. In that same span Kobe played with Gasol and Bynum, Pierce played with Ray Allen and Kevin Garnett, Duncan played with Tony Parker and Manu Ginobili. Also don't bring up the fact that Cavs had the best regular season record two years to say Lebron choked. 2009 Lebron played well against Orlando but his frontline (Ilgauskus and Varejao) were not equipped to defend Lewis and Howard. Whereas Kobe's frontline (Odom, Bynum, and Gasol) were. 2010 Lebron played poorly in game 5 but so did Kobe in game 7 of the NBA Finals its just his cast (Odom, Fisher, and Artest) hit the biggest shots. Artest was the best player in game 7 Kobe got most points in that game because he took 24 shots. Also it was proven that the Lakers personell were more equipped in shutting down Rondo and Garnett than the Cavs players (Mo Williams and Antawn Jamison). more

Resolved Question: Culinary Question....the industry?

Words cannot explain how excited I am to end high school. SE110RS! There are so many douche lords, and rude ignorant people, that I just cannot live in that environment. The field I am interested in is Baking and Pastry Arts. And I mean come on. Pastry Chefs always get the last say. Sure, you can eat a nice steak an potato dinner, but how about ending off that meal with a warm dark chocolate lava cake, oozing a smooth milk chocolate sauce, covered by a rich, decadent caramel sauce, and parted along side a cold french vanilla bean ice cream scoop...? Incredibly delicious... I have so much drive and passion for this I can just taste it at the tip of my tongue. I even run my own cake making business at home, and its an amazing experience! Being blessed with such a talent, and being able to cook and bring joy to people....love it. My goal is to eventually open up an upscale cafe/bakery bistro/cake shop. But the thing is most schools only offer Associates in Pastry Arts, and I want to get more out of this than just a measly A.S. degree. So you experienced chefs out there, whats your recommendation. I REALLY want my main focus to be on pastry arts....And I only am based im Chicago, so going out of state is a no go....too expensive for our budget. Voting Question: I need someone who has organizational talents to label my time management plan sink or float.?

i have problems with when unexpected stuff arises and interferes with my schedule--not good at adjustment, not good with rigid schedules. What if I, estimated the time it took to do certain things (eg homework, errands, studying, all that) and then added it up to get an idea for the total amount of time i need to spend doing all those things to get an idea for how much time i needed in the day. and then, everytime i found a free moment in my day, chipped away at the times, tackling my most important priorities first. then every time i did something, i would fill in its corresponding wedge (or part of it). if my time went over, i'd record how much time it actually took, and schedule that much time for the next same task (or any tasks similar to it). That way, as long as I know I need x amount of time and that much time is available in the day, i can plan for spontaneous, unscheduled things i have to do. is this plan destined for failure? My priority system would be like this: 1a: important must be done between 9-5 today 1b: has a time deadline of ___ 1c: important must be done by tomorrow 2: can be moved a day ahead 3: can be moved 2 days ahead 4: can be moved a week ahead. On my calendar, of course there would also be permanent events, commitments, and tasks. this system is for mostly my studying, and exercise, and all of that. Its just, that i know that there are random things that come up in college, and i wouldn't be sure whether or not my scheduled allowed me to do them with a rigid schedule. also, a rigid schedule doesn't allow for flexibility.To stacy: i'm taking a full load, and i'm in the honors college: 4 of my 5 classes are honors. I'm also already deeply involved in extracirrics. more

I have been interested in modeling and acting for a while, now, and I have looking around online for modeling agencies. I live in Missouri, and I know that there are a lot of scams. I found this one agency in Chesterfield, MO, and it's called West Model and Talent Management. I looked it up on The Better Business Bureau, and it isn't even there. Before I looked it up, I thought it was legitimate. It has a Facebook page and a website and everything, and I really thought it was legitimate and was planning on trying to sign with them. Resolved Question: Why wont the seattle seahawks go to a 3-4 defense?

Those of us Seahawk fans remember fearing the worst possible scenario when Lofa Tatupu went down last year. Many people doomed our season from that point and while the hawks didnt end up having a good season by any means, Tatupu's injury was a blessing in disguise. We all watched David Hawthorne step on the field and instantly become a monster with 117 tackles. Now my question is, why the heck can the coaches and management not see that this guy is WAY too talented to keep on the sideline as a backup. In my opinion our defense is perfect for a 3-4... we have fast linebackers who are great in coverage and can hold their own against the run, and our d-line is mediocre at best.. so why not have more good players on the field than bad. if we moved to a 3-4 we could put Curry up on the line as a standing d-end which i believe would suit his talents perfectly. He reminds me a lot of julian petersen and when we had petersen and he played the standing d-end role he dominated the pass rush. I can't be the only one who thinks this. There has to be a reason that is holding them back but i cant think of any.i fail to see how its a stupid question. but maybe i will reword it like this; why wont the hawks make the switch to a 3-4... as in why dont they pull in a def. coordinator who can and will run the 3-4. more

Resolved Question: How is Lebron's legacy ruined?

If you are talking about how Lebron had to leave his team and go team up with other stars to win a title, and how that ruins his legacy, open your eyes. No star player has ever won a championship on their own. Jordan didn't win sh*t before Pippen got there and Kobe hasn't won a title without either Shaq or Gasol in their prime. The difference is, those teams were able to bring in the high level talent to support them, the Cavs couldn't. They get Mo Williams-notorious choker, Shaq-a big man about 5 years downhill, and Antwan Jamison-yet another fading player. Management wasted so much money on these average players and Lebron just realized he would never get the help, so he went out and found a team that had the help. I don't see what is so offensive about that, he is doing what his team was unable to do for him. more

I saw this blogger's response to an article written about the "Three Kings" of Miami, and it basically sums up my sentiments completely. So I decided to use it and ask you guys what your take on it is: Kool Cass says: July 9, 2010 at 11:15 pm I have to agree somewhat with the posts by F_Lebron.com and COMEonMAN. However, I think you guys are both overlooking a couple of important details. I don’t know how old you are, but if you look at your NBA Championship teams dating back as far as you want to go, you will see that winning the Championship takes a team…that means help…not just any help, but quality help. If we focus on recent history, MJ didn’t win until Scottie came, but not just Scottie, those Bulls teams were solid; they weren’t just sneakers on the floor to make a pass or give a foul. Magic and Kareem don’t win 5 rings in the 80′s without Worthy, Wilkes, Scott, Cooper, A.C. Green, Rambis, McAdoo and Thompson. Bird doesn’t win without McHale, Johnson, Parrish, Walton, Carr, Ainge, et.al. I could go on but you get the point. In his fourth year in the league, LeBron took the Cavs to the Championship practically by himself and got swept by a team of great players. LeBron played incredible that year but he had average help. The reason the Lakers, Celtics, Bulls, Spurs, and Pistons had dynasties (Lakers and Celtics being the greatest of them all) is because the organization and management have championship mentalities. When Magic was unhappy playing for Westhead, Dr. Buss fired Westhead 11 games into the season and made Riley the coach after Jerry West declined the head coaching position and they won the Championship that year. When Kobe went public about wanting to be traded if the Lakers did not bring in quality players who wanted to play the right way, Dr. Buss and his management team made deals and brought in excellent talent to help Kobe lead a team back to the championship. That is why the Lakers have 16 (10 in LA). You don’t bring in Shaq when he’s on his way down or Jamison who can’t play defense and expect LeBron to lead them to the championship against the talent in the Eastern Conference and the Kobe led Lakers from the West. Give me a break…LeBron would have had success in Chicago quicker, but I think in three years, he and his friends will be in position to win a ring for the Heat; however, they need to put some good players around those guys or the elite teams in the East will eat them alive. The good news is they have Pat Riley in the front office (Laker pedigree) and he knows how to build a team that can win multiple championships and he has an owner who trusts him. That was not the situation in Cleveland. They don’t have the “know how” and they have the desire. But it takes more than that. The other big problem they have is Cleveland is not a destination city and it will be hard to get great talent to want to play there for an extended period of time. Lebron is from the area so it worked for him, but they could not get him the right help. They had 7 years to get it right and they did nothing in the last 3 years to improve the team to a championship winning level. It can be done. Boston did it two years ago. Oklahoma City is doing it. Don’t be surprised if it’s OKC and Miami in the FINALS in three years. Until then, the road to the NBA Championship must travel through LA and the Kobe Bryant led Lakers. Resolved Question: Did LeBron make the right choice to pick Miami over Cleveland and Chicago?

Let's just put some things into perspective. The Cavs had a roster of aging stars and underachievers. Shaq is past his prime. Jamison is not getting any younger and Mo Williams has not lived up to his sidekick expectation. Miami wasn't the best option available either because Chicago had the deepest roster and a younger team. However, Miami has a little bit of everything. No tax on income. A battle tested proven superstar (Wade) and legitimate frontcourt presence (Bosh) capable of helping James carry the load. A friendship foundation between Wade, James, and Bosh that is young enough to form a dynasty. Last but not least, a management leader in Pat Riley that has proved more than capable of bringing in more talent and coaching a championshp team. So at the end of the day, do you think LeBron made the right decision? Feel free to vent - Cavs fans, Bulls Fans, Knicks Fans, and all those who were misled into thinking the King was coming to your town.LAL - you do know that Bosh did not want to play in Cleveland right? So the sign and trade option even if it was available (but I doubt it because the Cavs just don't have the cap space), it would not have happened.Wade already said in the beginning that he is committed to signing with Miami so Bosh was the only moving piece available. It was either going to be at Bron's house or Wade's house but with Bosh leaning towards South Beach, LeBron would have had to play the waiting game. He would have to sign another another lucrative contract with the Cavs and waste another few years of his game with the hope that Wade and Bosh soon realize they need him more than he needs them by the time the next contract signing rolls around. more

Political and Economy Rules: These days so many things are getting weaker like management of political members and economical problems in many countries and i thought system could be changed if some young generation take some interest towards politics after their education. its not necessary to have experience like old people but heart to do your job and passion to learn about politics. Employment strategy: Only if ppl change the rules about looking for high experienced candidates and give jobs to talented graduates or someone who got the capacity to use their talents. i think things can be better if rules are changed. I applied through the 'Job Seek' website to be represented by the 'Blackbox Management Australia' acting/talent/modelling agency as I want to persue a career in acting and performance. I was contacted by phone later by a representative, who then emailed me application forms, and directed me to the website ( www.blackboxma.com ) and asked me to read the application terms and conditions (if you go to the website, click on the 'New Talent' tab and enter the password 'setup' to view the terms and conditions). In these, it states you must pay a fee of $195 for the webpage profile setup. I emailed and asked if this was essential to be paid, and got a response which stated 'the application process does not guarantee you will be part of the team, however if your application is successful you will be subjected to a screening test before being contracted'. Has anyone had any experience with this company? Are they an accredited management agency or is this just a money-making, get rich scam?? Any comments are greatly appreciated. more

Hi, I'm from hyderabad and I'm just a 12 passout , I have written various entrance test but got terrible marks in each one of them. I'm interested in computer's.. Programming ,compiler Design and stuff like that. but now none of the engineering colleges take me in. I'm really interested in CSE as I know C,C++,Java,.NET,SQL,Oracle and all other mini languages ... but i feel like crying now. Why do we have enterace test only of Math,Phy and chem .. these subjects are my best enemies,I do hate them a lotttt...and thats the reason why I never studied for entrance. Now this thing kills me.I'm from a poor family and my father cant afford to get a Management Seat.Why we dont have any entrance test of computers???.. Someone in upper management talked about my mom not having a good job...i honestly think she crossed the line right there. I was asked about what do my friends do, and i said one of them wants to go to law school, and i was told that my friend isn't smart and won't get in. In addition, they never met my mother or my friends. I get reprimanded at least every day, and they purposely find a flaw in me to criticize. They even said i had no talent. There were many times where i outperformed management if anything! In addition, they are paying me minimum wage and make me perform the work that management does! I'm putting in my 2 weeks soon after i get hired elsewhere. I rather put my time, talent, and service towards people who will appreciate me more. I attend an actor's conservatory and love it. i have been attending for a semester in los angeles and recently an opportunity has come about to model with a top agency. i am unsure of what to do. while this could be an amazing opportunity for me, it bugs me that i will not finish out the year getting training in what i most want to do- acting. i absolutely love modeling as well, which is why i went to the open call but wasn't neccessarily expecting the opportunity to travel and be on contract. the agency also has affiliates in talent representation such as L.A.
