I bought a fixer-upper house in June 2011, and I almost have the house completely renovated now (2 months later). I realize that if I sell it now, I will have to pay short-term capital gains on the proceeds (minus purchase price of house, minus expenses). But, if I sell it using land contract, rather than a regular sale with cash or mortgage, I won't get the full sale price immediately. It would come in installments, then a balloon at the end. Would I get taxed on only the actual amount that I receive each year, or would I have to pay taxes on the full sale price the same year, even before I get all the money (which could take 5 years). Or, would I be taxed on the full price after the 5 years when the land contract is completed? more

The problem with politics is that it has simply slipped into a habit of only seeking short term gains. This is why so many people take such partisan positions. Take healthcare: Many people on the left wanted a single payer system or something similar to universal healthcare as if it were the magic bullet to all of the healthcare dilemmas in this country. Many on the right wanted tort reform and the ability for people to shop for healthcare across state lines. The ideas and viewpoints of both sides sound nice when one talks and theorizes. But when you start adding up the numbers, neither side presents any real solutions that will work. Instead they produce talking points and slogans to get people fired up. Even the policies mandated in the bill itself have little to do with rhetoric so often stated by Democratic or Republican politicians. The many leaders of the parties (including the Tea Party) need political capital so they allow their own positions to be misrepresented as long as it means more votes for their cause. The party leaders know that the real solutions are ones that are very quantitative and unexciting in nature. The problem with healthcare cannot be boiled down into a slogan. It has much to do with improper cost shifting at a macro level, performance measures that only examine processes and not outcomes, a lack of transparency, and providers competing to see who has the best radiology centers instead of which team of medical professionals produce the healthiest people at the lowest cost. Like American politics the American healthcare system is too mired in the game of capturing short term gains and is slowly sinking as it loses the big picture. If you firmly believe that it is the left or the right that is correct, have you simply bought into the slogans without actually reading all of the facts that make up the real issue? more

Resolved Question: Does a stock "Wash Sale" apply to a gain or just loss?

In 2009, I had an automatic sell get triggered on a day when the market tanked. The sale was profitable. I owned the stock for less than a year, but still wanted to hold it, so I bought the same quantity of shares of the same stock the next day for close to the same price it sold. The definition of Wash Sale seems to apply only to sales for a loss, but would it apply to a positive sale as well? The real question I'm asking is does my 1-year time frame for going from short-term capital gains tax to long-term capital gains tax start from my original purchase date or my repurchase date? Or will I have to pay short-term capital gains on the first purchase and a new 1-year window started at the second purchase? more

I booked an under-construction apartment in India in June 2005. The agreement/sale deed was registered with the govt authorities same time. I paid the builder in installments based on the construction schedule and the final installment was paid in Aug 2007. I actually took the possession/keys of the apartment from the builder in Oct 2008. I am planning to sell of the apartment by June 2010. I want to know for the income tax purpose, whether the sale will attract short term or the long term capital gains? Or in other words, what is the date of aquisition of the property in this scenario? I am looking to start buying real estate tax liens as an investment but I am confused what capital gains I would need to pay. From what I read there is short and long term capital gains. Long term is for investments over 1 year. So would this be a case by case deal? If someone pays their lien off in 5 months i do short term for that particular investment, and if someone else takes 2 years than that one would be long term? Resolved Question: Capital Gains vs Capital Loss on sale of a house?

I built a house with the intent of moving into it. When the real estate market soured and we were unable to sell our existing house, we were forced to sell the recently built new house. So, although it wasn't my intent, we basically "flipped" the new house, after owning it for 8 months. Am I right to assume that this gets reported on Schedule D and assuming my cost basis is higher than my sale proceeds, I report a short term capital loss? If I had profited, I'm sure I would be taxed on the capital gain, since it would not qualify as my primary residence. Also, am I right to assume that my cost basis can include real estate commissions, cost to install a home stereo system, closing costs?VB, Am I understanding from you that if my intent was purely a speculative investment, that I would be able to take the short term capital loss, but if my intent was to make it my primary residence, I can't? Also, regardless of my intent, do I need to report this on a Schedule D? I did get a 1099S showing the proceeds from the Title company. more

Hi, I'm living in CA. Let's say I bought a house 5 years ago, and sold it in 2008. After deducting all expenses such as real estate fees, etc., I net a profit of $100,000. On the other hand, I bought stocks, yearly, from 5 years ago, until today. Some stocks I held for over 1 year (during the course of the last 5 years). Some stocks I sold in a few months (during the course of the last 5 years). Let's say, for the past 5 years, my total accumulative loss on the long-term stocks was $50,000. And my total accumulative loss on the short-term stocks was $50,000. The total loss on stocks for short term and long term is $100,000 for the past 5 years. I've been carrying the loss to the next year's taxes because I had no capital gains profit to write off these stock losses yet. If I sold that house now and had a capital gains of $100,000, can I write off that full amount because I had a total of $100,000 accumulative loss in the stock market in the past 5 years? Let's say I have 80K in adjustable gross income, and a capital gain of 200K from sale of a non-primary residence real-estate that we have owned for more than one year. The filing status is "married filing jointly." Here is a link to the 2006 tax schedules: http://www.irs.gov/formspubs/article/0,,id=150856,00.html Will I pay "$8,440.00 plus 25% of the amount over 61,300" for the 80K plus 15% of the 200K capital gain? Or will I pay "$42,170.00 plus 33% of the amount over 188,450" for the entire $280K? So is the 15% capital gains tax an extra tax on the 200K? I think I'm getting confused because I thought short term capital gains were taxed at a regular tax rate, but long term capital gains got the 5% or 15% tax rate. So how is the 15% applied in combination with the rest of my adustable gross income? Thank you for any information that you can provide. more
